On February 5, 2003, the U.S. District Court for the Eastern District of Louisiana granted a trucking company, s motion for summary judgment and dismissed a complaint filed by the widow of a driver employed by the trucking company.
While en route to his destination, the widow's husband suffered a stroke and fell unconscious in his truck in the parking lot of a truck stop. Although his truck engine was running, the truck driver was not discovered for approximately three days. Subsequently, the driver died several days later in a hospital as a result of not receiving prompt medical attention.
