Arthur Davis Communities, slapped with a lawsuit alleging non-payment of franchise fees to Arthur Rutenberg(R) Homes, has responded with a counterclaim, stating that Rutenberg did not provide proper construction plans, computer software and business planning services that were promised as part of the franchise. The counterclaim seeks $2.5 million based on violations of the Florida Franchise Act, fraud, and breach of the franchise agreement.
