Mr Koebler is employed as a university professor in Austria. After ten years of service, he applied for a length-of-service pay rise that professors are eligible for. Normally, professors can only get this in Austria if they have worked for 15 years. Mr Koebler had worked as a professor in other Member States, prior to 1986.
The university services said that, to get the pay rise, Mr Koebler would have had to have worked the full 15 years in Austria, so he took the case to the Austrian law courts.
