A judge today threw out molestation charges against defrocked priest George Cooley, saying the statute of limitations has expired.
Hamilton County Common Pleas Court Judge Richard Niehaus had told assistant prosecutor Mark Piepmeier at a hearing Wednesday that he disagreed with Piepmeier's interpretation of a law involving statutes of limitations.
Piepmeier argued the case against Cooley -- the 54-year-old former priest accused of eight counts of sexually touching a young boy -- should proceed because the statute of limitations on the charges didn't begin running until the alleged victim turned 18.
