A compromise in the dispute about California's authority to regulate small-engine pollution has satisfied both that state's leaders and Wisconsin's Briggs & Stratton Co. But the case serves as a warning that Congress should limit the extent to which California, or any other state, can solve its environmental problems by imposing costs on other states.
Why should California be able to avoid anti-pollution measures that would be costly to its own economy - and instead adopt a policy that kills off jobs in Wisconsin?
