Ofcom today published a statement of the guidelines it will follow in determining the amount of penalties it can impose on all those it regulates, in accordance with section 392 of the Communications Act 2003.
These guidelines will apply with effect from 29 December 2003. The imposition of any penalty by Ofcom must always be appropriate and proportionate to any contravention of a licence or authorisation condition or a statutory provision.
