On Wednesday April 14, the Federal Energy Regulatory Commission (FERC) announced that it has adopted two new market power screens to assess whether dominant generators exercise power over regional wholesale electricity markets. The new screens are described as interim measures that FERC will apply to assess applications for market-based rate authority (MBRA), both initial applications and triennial reviews of prior MBRA orders.
