Question: We have an employee who wears acrylic nails that are very long. She works in a health care facility, helping to care for our clients. We have concerns about infections because artificial nails can trap moisture and carry fungus. Also, the employee inadvertently scratched a client the other day. Can we legally require her to remove the nails, at least while she's at work?
Answer: Yes. You are free to establish dress codes, hygiene rules and grooming standards for your employees, as long as you have a legitimate business reason and apply your policies in a nondiscriminatory manner.
