St Louis, USA-based KV Pharmaceutical says that the US District Court for the District of Minnesota has denied a motion for a preliminary injunction filed by CIMA Labs and Schwarz Pharma, in a patent infringement action brought against KV and its subsidiary, ETHEX Corp. The Court's order is currently under seal, with KV and ETHEX asking the court to remove the seal except as to their proprietary information. The plaintiffs are resisting KV's efforts to allow the Court's legal analysis as to the denial of the motion to be placed in the public record.
