Union Carbide's (Danbury, CT) appeal of $2.8 million in fines imposed on it last September by the Occupational Safety and Health Administration (OSHA; CW, Sep. 25, 1991, p. 20) has gone before an administrative law judge of the OSHA commission. According to the company, it filed its notice to contest the fine, OSHA has filed a formal complaint, and Carbide in turn has filed a response.
The fines resulted from OSHA's investigation of the accident of Carbide's Seadrift complex in Port Lavaca, TX, on March 12, 1991, in which the Number One ethylene oxide redistillation still exploded. The blast and subsequent fire killed one plant employee and injured 32 others.
