WASHINGTON _ In a stinging rebuke to the U.S. Fifth Circuit Court of Appeals, the U.S. Supreme Court reversed the case of a Texas death row inmate Thursday, saying the lower court had not properly considered an appeal based on his mental retardation.
And in another death penalty case, a narrower majority rejected the claim of an Arizona inmate that his death sentence was unconstitutional because it was decided by a judge.
Both decisions, each in their way, are likely to affect a significant number of death penalty cases. At least 100 death row inmates in five states whose sentences were administered by judges now face more ...
