Premises liability. A Massachusetts appeals court has ruled that the trustees of a condominium complex cannot be held responsible for the assault of a resident when the resident's actions created the risk of such an assault.
Phyllis Feinstein lived on the fourth floor at the Independence Condominium complex. One July night, Feinstein left her sliding glass door open a few inches to get more air. She placed a small wooden dowel in the track of the door to prevent it from being opened further from the outside.
