GlaxoSmithKline PLC lost an important court case involving its top-selling drug when a federal judge in Chicago ruled that a Canadian drugmaker's generic version of Paxil did not infringe on Glaxo's original patent.
The ruling means that Apotex Inc. may be able to sell a generic version of the antidepressant Paxil, even though Glaxo's patent doesn't expire until 2006.
U.S. Judge Richard Posner said the chemical form of Apotex's version of Paxil differed and did not violate Glaxo's patent on the drug, known by the chemical name paroxetine hydrochloride.
