LAURELTON, N.Y. -- Eon Labs, Inc. (Nasdaq: ELAB) announced today that the U.S. District Court for the Eastern District of New York granted judgment in favor of Eon Labs ruling that, while the validity of the patent was upheld, the Company's Itraconazole 100mg capsules does not infringe Janssen Pharmaceutica N.V. and Janssen Pharmaceutica Products, L.P.'s U.S. Patent No. 5,633,015. Janssen has announced its intention to appeal the decision.
The temporary restraining order granted to Janssen prior to the trial preventing Eon Labs from selling Itraconazole capsules was also lifted. In May 2004 Eon Labs received final approval from the FDA for Itraconazole 100mg ...
