A California court decision that could cost insurers billions of dollars in environmental contamination claims will be appealed to the state's Supreme Court, the National Underwriter has learned.
At issue is a California Court of Appeal decision to apply a "continuous injury" coverage trigger. The court ruled that injuries and damage which are "continuous and progressive" throughout successive policy periods are covered by all policies in effect during those periods.
