The state of Ohio must repay Cuyahoga County more than $60 million in TANF funds that were illegally diverted away from welfare programs, a Cuyahoga County Court of Common Pleas judge ruled last week.
Ohio law requires that funds earmarked for a specific purpose must serve only that purpose, Judge David Matia noted. Therefore, the state did not have the authority to divert the TANF funds to help alleviate the $1.75 billion budget shortfall that occurred in Fiscal Year 2003.
