Batter-coated french fries can be considered "fresh vegetables," at least for accounting purposes, a federal jurist in the United States has ruled in a case that started with a bankrupt wholesaler trying get out of some of its debts.
Upholding a directive of the US Department of Agriculture, Federal District Judge Richard Schell said it was right to consider batter-coated french fries as fresh vegetables under the Perishable Agricultural Commodities Act (PACA), arguing that the potato in a batter-coated french fry is still considered fresh as it has not been preserved.
