The Federal Wiretap Act makes it illegal to intercept a telephone call. It also makes it illegal to intercept e-mail. Last year, we discussed an opinion of the Ninth Circuit Court of Appeals that concluded hacking a secure Web site generally does not violate the Wiretap Act. That act extends to the interception of electronic communications, but the court concluded that the word "intercept" is limited to acquisition of a communication that is contemporaneous with transmission.
