An Elgin woman is charged under a version of the state's reckless homicide law that wasn't on the books when the crime occurred, a defense lawyer said Friday.

As a result, Kane County prosecutors can't use drunkenness as a factor to try to convict Carrie Liska, who drove into a man walking home from a tavern, attorney Kevin Busch said.

Liska, 35, has pleaded innocent to reckless homicide and driving under the influence of alcohol for the Dec. 12, 2003, crash on Walnut Avenue that killed James Brown Sr.
