- Court Believes Trademarks Can Block the Use of Conflicting Trade Names
The European Court of Justice (ECJ) today issued a decision that paves the way for the Finnish Supreme Court to block Budejovicky Budvar's use of an alleged trade name in Finland.
The Court stated trade names can be prohibited from use when they are used in a manner causing confusion as to the origin of the goods. This decision will have a significant impact on the case involving Anheuser-Busch and Budejovicky Budvar in Finland.
