Many National Guard and Reserve members have been ordered to active duty. Hawaii employers have questions concerning employee military leave as a result of these developments. Draft regulations published by the U.S. Department of Labor answer many of these questions by interpreting the Uniformed Services and Employment and Reemployment Rights Act (USERRA) of 1994.
The regulations explain how USERRA prohibits employers from discriminating against employees (including applicants), because they belong, apply or have obligations to any federal military service (including National Guard and Air National Guard called for federal service).
