WASHINGTON -- The Environmental Protection Agency (EPA) has proposed that states be prevented from setting gasoline oxygen limits lower than the federal cap.

EPA published a notice in the Oct. 20 Federal Register in which the agency said its proposal would only apply to caps on oxygen levels between 2.7% and 3.51%. That would leave in place the federal maximum.

The federal limit of 3.51% oxygen permits use of gasolines that are 10% ethanol, which qualify for a federal tax break of 54 cents/gallon.
