A student held a pair of scissors just inches from the face of a Middleton teacher in a classroom last year, snapping them open and shut.
But instead of a criminal charge, the Dane County district attorney's office issued a letter of apology.
A heavy caseload and a staff depleted by vacations and illnesses had caused the district attorney's juvenile division to miss a deadline to file charges against the student, the letter read.
"I must ask you to accept my personal apology for this situation and that of my office," wrote Deputy District Attorney Michael Walsh.
