In its decision of May 4 2004 (Case 4 Ob 50/04p) the Supreme Court considered whether an ex-employee who processed his former employer's data had violated the Data Protection Act 2000.
The plaintiffs were the former employers of the first defendant, and their current employer was the second defendant. The first defendant provided data to the second defendant. This data was acquired by the first defendant at the time of his work for the plaintiffs, and concerned their suppliers, customers and products.
