The European Commission failed on April 11 to reach an agreement with the ten member states that supported it before the American courts in an action against the US cigarette manufacturer Philip Morris International (PMI), on the allocation of a billion euros which the manufacturer has pledged to pay to combat fraud (this agreement was concluded in July 2004). Germany felt it excessive that 9.7% of the sum should be paid into the Union budget. The ten member states (Belgium, Finland, France, Germany, Greece, Italy, Luxembourg, the Netherlands, Portugal and Spain) failed to agree on criteria for the allocation of the sum and the weighting of the member states.
