Sepracor Inc. today announced that it has been granted U.S. Patent No. 6,319,926 covering the use of ESTORRA(TM) brand eszopiclone for the treatment of insomnia, and U.S. Patent No. 6,444,673 covering the compound eszopiclone as well as pharmaceutical compositions containing eszopiclone.
The natural term of each of these patents runs until January 2012. Under the terms of the Drug Price Competition and Patent Term Restoration Act of 1984 (the Hatch-Waxman Act), upon U.S. Food and Drug Administration (FDA) approval of the ESTORRA New Drug Application (NDA), Sepracor would be permitted to apply for patent term extension for one of the ESTORRA patents.
