The New South Wales (NSW) Administrative Decisions Tribunal has found that a series of dutiable transactions should not have been combined. The case related to five adjacent properties purchased by the applicants from separate vendors for the purposes of redevelopment. The Chief Commissioner of State Revenue had aggregated the five purchase agreements to work out the stamp duty under s 25(1) of the Duties Act 1997 (NSW), a move which led to more duties having to be paid.
