Surcharging bans on ATMs in the commercial world have never gained legal traction. However, ATM processors that pass along ATM surcharges do so at their own peril for many transactions involving electronic benefits transfer cardholders.
Many state EBT contracts either cap or ban surcharging for EBT withdrawals, as Greenwood Village, Colo-based First Data Corp. recently can attest.
