The Wisconsin Supreme court ruled Thursday for a second time that Jefferson County prosecutors cannot use a bloodied sweatshirt in the trial of a Watertown man accused of a 1987 murder.
The court first voted 6 to 1 in 2003 to bar the sweatshirt in the trial of Matthew Knapp, ruling that authorities could not use physical evidence obtained before giving him the Miranda warning, which begins, "You have the right to remain silent." DNA tests showed the sweatshirt had the victim's blood on it.
But the U.S. Supreme Court forced the state justices to reconsider their decision after it ruled last year in a Colorado case ...
