Last week, the trial lawyers' association in New York urged its members whose clients have claims against vehicle leasing companies to sue quickly.
The reason: The new federal highway bill bars vicarious liability lawsuits nationwide. President Bush is expected to sign the measure Wednesday, Aug. 10.
Under vicarious liability, a person who is hurt in a crash with a leased or rented car or truck can collect damages from the vehicle's leasing or rental company, not just from the other driver. Including New York, 16 states recognize some form of vicarious liability.
