The Michigan Court of Appeals recently rejected an attempt to impose the state's use tax on items shipped outside of Michigan for use outside of Michigan.1 The lesson to be drawn is that what might be subject to use tax in one state might not be subject to use tax in another state due to different interpretations of the law. Taxpayers need to examine the laws of each state in particular.
