Having lost the first case relating to alleged deaths and heart attacks associated with its now withdrawn COX-2 inhibitor Vioxx (rofecoxib; Marketletter September 5), Merck & Co won a major victory in a second trial - Humeston versus Merck -when, on November 3, a New Jersey jury found (by a majority of eight to one) that the company not liable, saying that it had warned patients of the risk associated with the drug.
The jurists also ruled unanimously that the firm had not defrauded consumers, nor had it misrepresented or intentionally concealed or suppressed Vioxx' heart risks. Ahead of its withdrawal last year because of cardiac safety concerns, the drug was ...
