The European Commission has drafted a proposal which, if adopted, will impose onerous obligations on providers of communications. It sets out measures for the mandatory retention of communications traffic data across the EU.

UK businesses are accustomed to retaining documents for regulatory purposes or in anticipation of potential litigation, but this proposal takes things much further. Providers of publicly available electronic communications or public telecoms networks would be required to retain data relating to mobile and fixed telephony for a year, and online communications data for six months.
