SACRAMENTO, CA -- Mortgage wholesalers who do business with broker offices in California have a reprieve of sorts from a tough new do-not-fax law that was scheduled to go into effect in this state on Jan. 1.
The Federal District Court here has stayed implementation of the law until after it holds a hearing on Jan. 23.
The U.S. Chamber of Commerce and Xpedite Systems filed a lawsuit seeking to have the law declared to be pre-empted by a federal statute passed in 2005.
California's law would prevent companies from sending faxes when a recipient has not previously provided written consent.
