May 02--Circuit Judge Glenn Hess sided Monday with Bay County in a lawsuit filed by the losing bidder on the new jail project.
Hess dismissed a lawsuit from Emerald Correctional Management of Louisiana in which the company claims it was unfairly treated in negotiations for the construction and maintenance of a new 680-bed, $35 million expansion of the existing jail annex on Nehi Road.
Hess stated in his ruling that the county was saved by the wide discretion afforded to it by law in the process of issuing a request for proposals, or RFP, instead of asking for bids.
