City may deny cell tower permit on aesthetic grounds.

The Kansas Court of Appeals has ruled a city council could rely on aesthetic considerations in rejecting a conditional use permit application for a 135-foot-tall "stealth" wireless communications antenna (R. H. Gump Revocable Trust v. City of Wichita, No. 94, 312, April 14, 2006).

In 2003, Gump applied for a conditional use permit for a stealth flagpole tower, 135 feet high, with the ability to be extended to 165 feet to accommodate additional equipment, in a mixed commercial and residential use district.
