COURT: GRAND JURY SHOULD NOT INDICT THOSE WHO ARE PARDONED.(News)

FRANKFORT -- A special grand jury investigating the hiring practices of Gov. Ernie Fletcher's administration should not issue indictments against people covered by a gubernatorial pardon, the Kentucky Supreme Court ruled Thursday.

"A gubernatorial pardon operates to cease any further legal proceeding concerning the pardon conduct including indictments," Justice Martin Johnstone wrote in the court's 4-2 opinion.

The grand jury indicted Fletcher last week on misdemeanor charges of criminal conspiracy, official misconduct and violating a prohibition against political discrimination. The indictment was among 29 issued in the case ...
