Do varying interpretations of the right to be presumed innocent cause problems in cross-border cases? If so, would EU legislation help boost mutual trust? These are the two key questions posed by the European Commission in a Green Paper published on 26 April.
The initiative came just as EU Justice and Home Affairs Ministers failed yet again to reach agreement on a draft Framework Decision on the rights of criminal suspects. Some member states oppose any EU legislation in this domain, while the Commission insists there is a legal basis under Article 31.c of the EU Treaty.
