Pakistani national Khalid Rashid is no longer in the custody of the South African Government nor is he still in the country, therefore an application by his lawyer to have his arrest, detention and subsequent deportation declared unlawful, was not urgent.

This was the finding of Pretoria High Court judge Francis Legodi yesterday. The judge said Rashid's lawyer Zehir Omar could bring this application through the normal channels by way of an opposed motion, which will be heard by a full bench (three judges).
