A court ruling forcing a psychologist treating a rape victim to hand over confidential notes of all counselling sessions to the alleged rapist was subjecting rape survivors to secondary abuse at the hands of the criminal justice system.
This will be the argument in a High Court challenge next week which, if successful, will change common law in South Africa, extending the concept of privilege beyond that of attorney/client to cover that between doctor and patient.
