NEW YORK -- The law firm of Milberg Weiss is investigating possible illegal conduct relating to 401(k) retirement plans at computer maker Dell Inc. Specifically, Milberg Weiss is investigating whether fiduciaries of the Dell Inc. 401(k) Plan and the Dell Financial Services LP 401(k) Plan may have violated the Employee Retirement Income Security Act of 1974 ("ERISA") in at least two ways: (1) by failing to disclose Dell's true financial condition to participants in Dell's 401(k) plans, and (2) by offering Dell common stock as an investment option under Dell's 401(k) plans when it was not prudent to do so.
