In a case of vital interest to grandparents cut off from their grandchildren, New York's highest court will decide whether the grandparents of a 5-year-old boy can seek visitation rights over the objections of the child's parents.
The matter of Emanual S. vs. Joseph E., to be argued June 5 before the Court of Appeals, marks the second time this year that the panel has been asked to referee a tug of war over a child and to decide if a jurist has any business substituting his judgment for that of a fit natural parent.
