Twice this year the state's highest court has turned its back on the U.S. Supreme Court and carved for New Yorkers free-speech rights and criminal- suspect protections far broader than those required under the federal constitution.
While the court has long been nationally famous - critics say infamous - for its independence, the recent nose-thumbings at the U.S. Supreme Court have raised eyebrows in the legal community and prompted spirited debate on the Court of Appeals itself.
At issue is whether the state panel should deprive the U.S. Supreme Court of an opportunity to review and refine constitutional matters.
