Dec. 28--JEDDS -- Akron has again prevailed in a lawsuit that challenged a joint economic development district involving the city, Fairlawn and Bath Township. In a 3-0 decision issued Wednesday, the Ohio 9th District Court of Appeals affirmed Summit County Common Pleas Judge Marvin Shapiro's dismissal of the lawsuit. In 2005, developer John Dellagnese III sued Akron, Fairlawn and Bath Township, as well as the JEDD, contending that Akron was creating an uneven playing field for developers by using money from JEDDs to promote business within Akron's borders.
