A legal dispute over a sewer line between the Saratoga and Wilton malls is headed back to state Supreme Court, where a trial will be necessary to resolve the matter.
In a decision filed Thursday at the Saratoga County Clerk's office, a state Appellate Court panel upheld a state Supreme Court's preliminary injunction preventing the owners of the Wilton Mall from disconnecting the Saratoga Mall from a sewer line. Wilton Mall claims it owns the sewer line.
However, the judicial panel also concurred with the lower court that the Wilton Mall's claim of ownership to the line cannot be determined without a full trial.
