TROY -- Robert Hathaway's blood-alcohol content on the day he was shot to death two years ago again became a focus of a Rensselaer County murder trial Monday as Duane Gabriel's defense attorneys sought to prove his foster father may have been taunting him.
The debate over the alcohol content erupted during the testimony of the county's chief medical examiner, Dr. Aniceto Lomotan, whose primary purpose was to identify the wounds inflicted upon 46-year-old Robert Hathaway and his 17-year-old son, Michael, and issue the cause of death.
