Disbarred attorney Andrew F. Capoccia, accused of bilking debt-ridden clients for millions of dollars, said in an affidavit that he is indigent and will file for Chapter 11 bankruptcy.
In an affidavit filed recently in a civil contempt of court case, Capoccia claimed he is unable to pay the more than $400,000 that a judge ordered he turn over to KeyBank, which has taken over debt owed to a law firm that used to represent him.
Capoccia has not yet filed for bankruptcy, according to federal court records. He declined to comment, and his attorney, E. Stewart Jones, did not return calls Wednesday.
