Centre defends amendment to Indian Patents Act

Chennai, Feb 22 (PTI) Strongly defending an amendment to the Indian Patents Act, the Centre today contended that it did not violate the TRIPS agreement as alleged by Switzerland- based pharmaceutical major Novartis AG.

Stating that Section 3(d) of the Act with its explanation was "valid", Additional Solicitor General V T Gopalan, appearing on behalf of the Centre, claimed in the Madras High Court that the amendment did not provide any unguided power to patent controllers to reject applications for patents on the ground that they were not new inventions.
