Novartis says Indian Patents Act violated TRIPS

Chennai, Mar 5 (PTI) Switzerland-based pharmaceutical major Novartis AG today contended before the Madras High Court that the Centre's amendment to the Indian Patents Act "violated" the TRIPS agreement.

It told a division bench of Justices R Balasubramanian and Prabha Sridevan that its application for patenting the beta crystalline form of Imatinib Mesylate was rejected under section 3(d) of the Act.
