May 10--Richard Kinney underwent surgery to repair a hernia in late October 2003.
Just over four months later, the Canal Fulton man, 68, was dead -- the result of what a lawsuit contends was a defective patch.
On Tuesday, Kinney's estate filed suit in U.S. District Court in Akron against Davol Inc. of Rhode Island, the manufacturer of the patch, known as a Composix Kugel Mesh Patch. Also being sued for an undetermined amount of money is Davol's parent company, C.R. Bard Inc. of New Jersey.
